When a Property POA Is Used

A property power of attorney is used when the owner of a Dubai property cannot attend in person for a transaction at the Dubai Land Department or a trustee office. Common situations include selling a property while based abroad, authorising someone to attend a handover, executing a mortgage release, or completing a gift transfer.

Without a valid property POA, the DLD will not process the transaction. The document must be drafted with scope that matches the specific action being taken.

Scope Matters

Property POAs are not one-size-fits-all. A POA for selling a specific property is drafted differently from one for managing tenancy agreements or completing a purchase. The scope clauses must align with the transaction type, the property details, and the authority requirements.

Broad or vaguely worded property POAs are more likely to face questions at the point of use. Where possible, a specific POA referencing the exact property and action is preferable.

DLD and Trustee Requirements

The Dubai Land Department has specific expectations for POA documents used in property transactions. These include correct referencing of the property, clear identification of the parties, and scope clauses that match the intended action. Trustee office registration and Form F requirements should be accounted for during drafting, not after notarisation.
